Well, true, untrue, true... My exclusively personal view :

The COD never said to copy data in commercial databases.

The COD says to use the breach in the commercial
system.

Indeed, there is a large breach : most published papers have a
footnote telling that crystal data can be obtained free of charge :
"CCDC ...... contains the supplementary crystallographic data for this 
paper. These data can be obtained free of charge via 
www.ccdc.cam.ac.uk/conts/retrieving.html (or from the Cambridge 
Crystallographic Data Centre, 12, Union Road, Cambridge CB2 1EZ, UK; fax: 
+44 1223 336033; or deposit@ccdc.cam.ac.uk) "
(and an equivalent statement for FIZ-ICSD)

When the paper does not list the atomic coordinates in a table, this
is the unique possibility to obtain them if you have not paid for
the CSD/ICSD database access.

To use that breach, you may well not having at all access to CSD
and/or ICSD and have not sign the licence. Indeed, that offer is clearly
addressed to people not having access to these databases (why to
ask for these data if you have access ?). Nothing is said in the above
text about any restriction on future use. The above statement results
from agreements between databases and journals that want to save
place by not giving the (essential) supplementary data which is
alternately deposited at CCDC/FIZ.

But for having access, you should be able to prove that you have
at least the paper version of the article, since the CCDC/FIZ request
form ask you for the journal name, the year, the pages, AND the
deposition number... You have to prove that you have already paid
once somwhere in the scientific publishing system.

Some want that you pay twice and that you cannot do anything
with the data ! Make your own opinion.
